1. Acceptance of Terms
By accessing or using SnapperHQ's services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.
2. Description of Service
SnapperHQ is a white-label Software-as-a-Service (SaaS) platform that provides comprehensive business management and marketing automation tools for real estate media professionals, including but not limited to:
- Professional photographers specializing in real estate
- Videographers and virtual tour creators
- 3D scanning and virtual staging professionals
- Drone operators and aerial photography specialists
- Marketing agencies serving real estate clients
- Other media service providers in the real estate industry
Our platform enables media professionals to operate under their own brand while providing:
- Client relationship management (CRM) systems
- Project and order management workflows
- Automated marketing campaign creation and management
- Multi-platform advertising integration (Facebook, Google, LinkedIn, etc.)
- Custom-branded client portals and booking systems
- Media delivery and gallery management
- Payment processing and invoicing
- Analytics, reporting, and business intelligence tools
- White-label website and subdomain hosting
3. User Accounts and Responsibilities
Account Registration
- You must provide accurate and complete information
- You are responsible for maintaining account security
- You must be at least 18 years old to use our services
- One person or entity may not maintain multiple accounts
User Conduct
You agree not to:
- Use the service for any illegal, fraudulent, or unauthorized purpose
- Upload, distribute, or transmit any content that infringes intellectual property rights
- Misrepresent your identity, credentials, or business qualifications
- Upload malicious code, viruses, or any harmful software
- Violate any applicable laws, regulations, or third-party platform policies
- Attempt to reverse engineer, decompile, or extract source code
- Engage in any activity that could damage, disable, or impair the service
- Use automated systems to access the service without authorization
- Sublicense, resell, or redistribute the service without written consent
- Remove, alter, or obscure any proprietary notices or branding
4. Third-Party Platform Integration
SnapperHQ integrates with various third-party platforms including Facebook, Instagram, Google Ads, LinkedIn, and others:
- You must comply with each platform's terms of service and policies
- You grant SnapperHQ permission to access your connected accounts as authorized
- You are responsible for any costs incurred on third-party platforms
- SnapperHQ is not responsible for changes to third-party platform policies
- You can revoke platform access at any time through your account settings
5. Payment Terms
Subscription Fees
- Subscription fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- We may change pricing with 30 days' notice
- Failure to pay may result in service suspension or termination
Advertising Costs
- You are responsible for all advertising spend on connected platforms
- SnapperHQ does not guarantee advertising performance or results
- You set and control your advertising budgets
- Advertising costs are separate from SnapperHQ subscription fees
6. Intellectual Property
Your Content
- You retain ownership of all content you upload
- You grant SnapperHQ a license to use your content to provide services
- You represent that you have rights to all uploaded content
- You are responsible for ensuring content doesn't infringe third-party rights
SnapperHQ Property
- SnapperHQ owns all rights to the platform, software, and technology
- You may not copy, modify, or reverse engineer our services
- Our trademarks and logos are protected intellectual property
7. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Service Availability
- We strive for 99.9% uptime but cannot guarantee uninterrupted service
- Scheduled maintenance will be announced in advance when possible
- We are not liable for service interruptions beyond our control
- We may modify or discontinue features with reasonable notice
9. Limitation of Liability
IMPORTANT LEGAL NOTICE:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPPERHQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold SnapperHQ harmless from any claims, damages, or expenses arising from your use of the service, violation of these Terms, or infringement of third-party rights.
11. Termination
By You
- You may cancel your account at any time
- Cancellation takes effect at the end of your current billing period
- You remain responsible for all charges incurred before cancellation
By SnapperHQ
- We may suspend or terminate accounts for Terms violations
- We may terminate the service with 30 days' notice
- Immediate termination may occur for serious violations
12. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of such courts.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of the service constitutes acceptance of modified Terms.
